44. ONLINE CURRENT ART AUCTION

Online auctions are subject to the provisions of Article 274 of the Turkish Code of Obligations and are outside the scope of the general provisions of the distance sales contract regulated in Article 48 of the Consumer Law, therefore the person participating in the auction does not have the right to "cancel the sale, right of withdrawal or refrain from purchasing" after the auction. If the person remaining after the auction does not pay the price of the works he bid for in full within 7 days, he has the right to terminate the balaban auction sales contract, to collect all the losses he has suffered together with the commercial interest and the monthly interest of 5% to be applied as of the date of the commission invoice. When the participants bid, they are deemed to have accepted these terms in advance.
